According to Newspaperthe case was brought before the CJEU by the Court of Appeal of Cluj, in Romania, which received a complaint from a worker who asked his employer to reimburse him for the value of prescription glasses he had bought in order to be able to work in front of the monitor.
The Court of Justice of the European Union gave reason to the employee and explained that the company could choose to supply its own glasses or contact lenses or request reimbursement of expenses paid by the employee, but “not through payment of a salary premium”, says the JN.
This measure was already transposed into Portuguese law in 1993. Article 7 of Decree-Law 149/91 states that workers who carry out their duties in front of a monitor “must undergo an adequate medical examination of the eyes and of vision”.
As for paying for glasses or contact lenses, the law states that “whenever the results of medical examinations require it and normal correction devices cannot be used, workers must be provided with special correction devices designed for the type of work developed”.
In case of non-compliance, the law says that the fine ranges from 250 to 500 euros.
