Robinson Teixeira dos Santos, one of the seven defendants in the Eliseu Santos case, was doomed in the early hours of this Friday (23), in Porto Alegre, the 32 years, 1 month and 15 days in prisonin closed initial regime, most 1 year and 4 months of detention, for the crime of procedural fraud, in an initial semi-open regime. He was one of those accused of the murder of the then Secretary of Health of the Capital, on the night of February 26, 2010, in the Floresta neighborhood, when he was leaving a cult with his wife and seven-year-old daughter.

“A child growing up without a father is a very serious consequence”, stressed the magistrate. “Today, the daughter doesn’t even utter the word ‘father,'” he added.

Robinson was denounced by the Public Ministry (MP) for the crimes of qualified homicide, criminal association, procedural fraud, receiving and tampering with motor vehicle identifier signal. For these crimes, Judge Thomas Vinícius Schons, of the 1st Court of the 1st Court of the Jury of the Capital, sentenced the defendant to:

  • Qualified murder: 25 years in prison
  • Reception: 1 year and 6 months of imprisonment
  • Tampering with vehicle identifier sign 3 years and 9 months imprisonment
  • Procedural fraud: 1 year and 4 months of detention
  • Criminal association: 1 year and 10 months imprisonment

The defense can appeal. During the jury trial, lawyer Pâmela Farias supported the thesis that Robinho, as he was known, was not at the scene of the crime and that the evidence was insufficient.

The case process went through splits, with 12 cases in all. Of these, two cases have already been judged and one had the punishment extinguished by the statute of limitations (related crime). There are still two cases pending in the instruction and seven cases to be judged by December.

Defendant in the death of former Porto Alegre Health Secretary is tried this Thursday

The jury was presided over by Judge Thomas Vinícius Schons, from the 1st Court of the 1st Court of the Jury of the Capital, and had a Sentencing Council composed of three men and four women.

The defendant’s defense was represented by lawyers Cássia Juliana Vargas Dornelles, Diorge Diander da Cunha Rocha and Pâmela Donida Farias. On behalf of the Public Prosecutor’s Office, the Prosecutors Lúcia Helena Callegari and Eugênio Paes Amorin acted.

The first prosecution witness heard was Fábio Rodrigo Lasta. He lived near the scene of the crime and, upon hearing the shots, went downstairs and saw the victim already dead. Afterwards, witness Denise Goulart da Silva, widow of Eliseu Santos, was heard. She told how the action went that night.

“I learned a lot of things after his death. I learned from the press. I asked him who always said: don’t worry”, says Denise.

The third witness heard was Leudo Iraja Santos Costa. He stated, during his testimony, that “Marcelo Pio wanted to kill Eliseu all the time. Very angry”, says Leudo Costa. The last witness to be heard was Sylvio Edmundo dos Santos Júnior, this Thursday afternoon.

At the time of the events, the civil police officer worked in the steering team that was linked to the State Department of Criminal Investigations (DEIC). Sylvio moved with his team to the location. He reported that he received, on the night of the crime, calls from two defendants in the process and understood that they could be to create an alibi.

Afterwards, the defendant Robinson Teixeira dos Santos was interrogated. “I was investigated for car theft at the time and they put me in this murder case,” says defendant Robinson, who claims he did not know the victim Elisha.

He claimed that they would be in Tramandaí, on the North Coast, on the night of the crime. The prosecution disputed the information during the final debate.

“Robinho (Robinson) said he was on the beach, but his phone made and received calls the night of the crime from the Sapucaia and Porto Alegre area,” said prosecutor Lúcia Helena Callegari.

  • 10/19/22: Jorge Renato Hordoff de Mello
  • 11/23/22: Jonatas Pompeu Gomes and Marcelo Machado Pio
  • 12/12/22: Cássio Medeiros de Abreu, Marco Antonio de Souza Bernardes and José Carlos Elmer Brack

Eliseu Santos was accompanied by his wife and daughter on the way out of a religious cult when he was murdered. He was hit by shots fired by suspects who were in a Vectra.

The orthopedist was deputy mayor in the first term of Mayor José Fogaça in Porto Alegre, between 2005 and 2008, and took over the Health Ministry in 2007.
