Former deputy Daniel Silveira (PTB-RJ) was arrested today in Petrópolis (60 km from Rio) for non-compliance with a precautionary measure, according to the Federal Police. Around 11:30 am, he checked in at the PF headquarters in the capital of Rio de Janeiro in a company car.
The warrant was issued by Minister Alexandre de Moraes, of the STF (Federal Supreme Court).
The arrest takes place on the same day that Senator Marcos do Val (Podemos-ES) revealed, in an interview with Veja magazine, that he had sought out Alexandre de Moraes to tell him about an alleged coup plot to which he had been invited and which was being devised by the former president Jair Bolsonaro (PL) and by Silveira (PTB-RJ), arrested today. The STF minister’s warrant, however, does not mention the episode.
Lawyer Jean Garcia, who defends Daniel Silveira, classified Do Val’s account as “speculation”. “About the declarations of Senator Marcos do Val (Podemos-ES), while he does not present concrete evidence, proven facts, it is just speculation. We do not comment on speculation”, said the defender.
According to the decision, Silveira failed to comply with the conditions for his freedom by:
- damage the electronic anklet;
- return to threaten ministers of the STF and TSE (Superior Electoral Court);
- raise doubts about electronic voting machines, including interviews with media outlets;
- try to create new accounts on social networks.
Silveira already accumulated almost BRL 4.4 million in finesas the Court had fixed the payment of BRL 15,000 per day for each infraction.
In the case under analysis, it is amply demonstrated, given the repeated violations, the inadequacy of the precautionary measures in ceasing the periculum libertaris [perigo de liberdade] investigated, which indicates the need to reestablish the prison, not being envisaged, for the time being, other measures capable of fulfilling its function.

Silveira ran for the Senate last year but failed to get elected despite receiving more than 1.5 million votes. As yesterday was the beginning of the new legislature, he lost the privileged forum.
Yesterday, the PGR (Attorney General of the Republic) sent a request to Moraes’ office requesting that the case be sent to the Justice of Rio, since the former deputy no longer had the right to the special forum.
PF found BRL 270 thousand in cash
The minister’s dispatch authorized search and seizure operations at Silveira’s business and residential addresses. In one of these, BRL 270,000 in cash were found, according to the PF.
In addition, the decision ordered agents to collect:
- weapons;
- ammunition;
- computers;
- tablets;
- cell phones;
- items found inside vehicles.
The minister even had Silveira’s passport canceled and documents for carrying firearms and the CAC (hunter, shooter or collector) record immediately suspended.
Last year, Silveira was sentenced by the STF to eight years and nine months in prison for the crimes of trying to prevent the free exercise of Powers and coercion in a judicial process. The following day, former President Jair Bolsonaro (PL) pardoned him.
In today’s decision, Moraes recalled this pardon. The minister stated, however, that while there is no decision by the STF on the constitutionality of the pardon, the process against Silveira will run “normally”.
Silveira’s defense did not comment on the content of Moraes’ decision against the former deputy.
