According to the defense lawyer, Leonardo Gagno, the investigation was concluded and closed by the police, on the understanding that Costa acted in self-defense.
“There was the final report of the investigation by the police chief, Dr. Ramiro, who decided to dismiss Luís, because he understood that there was self-defense. As a result, he asked for the investigation to be closed and released,” the defense explained.
According to Gagno, the request for release came on Thursday night (2), however, due to the necessary procedures, Luis Hormindo was only released at the end of the following day. He further explained that the Court established compliance with precautionary measures.
“It was decided (Luis Hormindo) that he should present himself to the Forum once a month, that he not carry a firearm and that he does not frequent shooting clubs. (…) But he is already at home, he is with his family”, added the lawyer .
Luis Hormindo was named as the main suspect in the shooting death of retired Manoel de Oliveira Pepino, aged 73, after a disagreement between the two over dogs in Mata da Praia, in Vitória.
The day after the crime, the lawyer underwent a custody hearing and the court converted his arrest into preventive detention. He was then transferred to Medium Security Penitentiary 1.
The Civil Police, who were conducting the investigation into the case, were asked about the progress of the investigation and the text will be updated when there is a response.

An argument between two dog owners led to an exchange of gunfire and culminated in the death of one of the shooters, last Saturday (20), in Mata da Praia, in Vitória.
Retired Manoel de Oliveira Pepino, 73, was shot in the head and died after a dispute with lawyer Luis Hormindo França Costa, 33, who was arrested after the murder.
The suspect was taken to the Vitória Regional Police Station, where he was charged with murder and committing an act of abuse against a dog, as the animal was also shot.
