The 1st Federal Court of Gravataí, in the Metropolitan Region of Porto Alegre, ordered the federal government to pay R$100,000 to the family of a Samu (Mobile Emergency Care Service) rescuer who died as a result of Covid-19.

According to information released on Friday night (1st) by the Federal Court, the man’s wife and son filed a lawsuit against the Union alleging that the rescuer died at the age of 45 as a result of the disease. They stated that he worked as a first aid driver for Samu in the Palmeira das Missões region, in the North of the State, for more than five years, starting in June 2014 and remaining active until he was infected by the coronavirus, precisely because he worked on the security line. front in the fight against the disease.

When analyzing the evidence attached to the case, judge Bruno Polgati Diehl noted that they attested to the work carried out by the man and the causes of his death. He noted that Law 14,128/2021 defined that the families of health professionals, who died as a result of Covid-19, who worked in direct care for patients affected by this disease, are entitled to financial compensation.

The judge stated that the law provides that the families of deceased workers have the right to receive R$50,000 in compensation, which must be divided equally between spouses and dependents. In relation to the son, according to the norm, a portion calculated by multiplying R$ 10 thousand by the number of whole and incomplete years that were missing, on the date of the father’s death, for him to turn 21 years old. Diehl concluded that the boy was entitled to R$50,000, considering that he was 16 years old at the time of his death.

In its defense, the Union maintained the existence of budgetary limits, the lack of carelessness on its part and the failure to meet the requirements for its liability. The decision may be appealed to the TRF4 (Federal Regional Court of the 4th Region).
