Oswaldo Prado Rocha, arrested in May 2023, in Pocon, for being part of a cattle theft gang, was held in prison by the Superior Court of Justice (STJ). The decision of the Sixth Panel was handed down unanimously, in a virtual trial session that took place between April 16th and 22nd.

Oswaldo is the nephew of Rosy Prado (UNIO), councilor of Vrzea Grande. According to police investigations, on May 10, around 7 pm, on a rural property located in the Nossa Senhora Aparecida Settlement, in Vrzea Grande, Oswaldo and two other accomplices stole cattle from RLSC and EGMS

According to the records, he was carrying a firearm and the other accomplice was carrying a pistol, and several objects were taken from the victims, who recorded the incident and gave a statement, having recognized the parliamentarian’s nephew from a photograph as being one of the perpetrators of the robbery.

After the Court of Justice maintained his preventive detention, Owsaldo’s defense appealed via habeas corpus to the STJ, arguing that an illegal constraint had occurred, since the appellant’s procedural segregation, with favorable personal predicates, is unfounded, and that the same unnecessary.

It was maintained that Oswaldo was arrested and paid bail to be released. However, seven months later he had preventive detention ordered for the same facts that led him to be released at the police station, and that there is no new fact to maintain segregation. With this, he asked the HC for a concession to revoke the detention through the application of precautionary measures.

Examining the appeal, the reporting minister rejected the argument of illegal constraint due to excessive deadlines, since the precautionary measure was imposed in view of the concrete gravity of the crime, which caused unrest in Pocone society, revealed by the way in which the robberies were carried out, as well as the dangerousness of the accused.

After taking a position to reject the claim, Jesuno had the vote followed by the other magistrates in the group. The summary of the ruling, then, defined that there is no constraint when the prison is ordered in view of the concrete gravity of the crime, especially when evidenced by the modus operandi with which the crime was committed.

Furthermore, the rapporteur recalled that Oswaldo and other accomplices carried out two robberies against truck drivers who were transporting cattle, the cargo being of high value, as well as that they used firearms and, through violence, restricted the drivers’ freedom during the action.

Covid diversion scheme

One week after leaving prison for the crime of robbery, the superintendent of secondary care at the Vrzea Grande Municipal Health Department, Oswaldo Prado Rocha, was arrested for leading a drug diversion scheme from the Emergency Care Unit (Upa Ipase) pharmacy. of Vrzea Grande, on May 22, 2023. This fact was considered by the minister to keep him in prison.

“The records state that Oswaldo carried a firearm and the other accomplice had a pistol, with several objects being taken from the victims”, with the risk of repeating the crime being also highlighted, as another criminal action was reported for events that occurred on a near date, he wrote in decision.

Oswaldo was the target of operation “Fenestra”, launched by the Specialized Police Station for Combating Corruption (Deccor). In addition to him, some heads of the Upa Ipase pharmacy and the pharmaceutical businessman, Fernando Metelo, owner of the company Disnorma Comrcio Atacadista de Medicamentos, located on Rua Baro de Melgaão, in Cuiab, are targets.

The investigations began in April 2022 and revealed the involvement of employees from the Municipal Health Department of Vrzea Grande, including the superintendent, pharmacy heads, drivers and assistants.

According to Deccor’s investigation, the medicines were received by the businessman who used “langes” to pay undue advantages to public agents, through bank transfers and vehicle purchases, with the aim of illicitly hiding the goods and valuables.
