The family of a nurse who died of Covid-19 at the age of 50 obtained the right to compensation of R$200,000 at the 1st Federal Civil and Criminal Court of Acre for the death of the professional, who worked on the front line of combating the pandemic. at the Rio Branco Urgency and Emergency Hospital. The decision can still be appealed.

The right is guaranteed by Law 14,128/2021. According to the sentence, the family must share the basic amount of R$50,000. The daughter, who was 16 years old at the time of her death, was compensated an additional R$50,000 and the son, who was 10 years old, is entitled to receive an additional R$100,000.

Judge Wendelson Pereira Pessoa considered the professional’s employment relationship, his work on the front line in the fight against Covid-19 and the infection as the cause of death proven. “It is important to note that the professional worked in urgent and emergency services, highly exposed to occupational risk of contagion in a period in which the pandemic had a sharp resurgence in the region”, pointed out the judge.

Law 14,128/2021 guarantees compensation of R$50,000 to nursing professionals unable to work due to Covid-19 and also provides for the granting of the amount to family members and dependents, in the event of the worker’s death. Minors under 21 are also entitled to R$10,000 per year, until they reach the age of majority. If the dependent is a student, the benefit is granted until the age of 24.
