The narrow four-to-three court ruling surprisingly overturned one of the defining cases of the MeToo movement, although Weinstein remains in prison on a separate 16-year rape sentence handed down in California.
“The New York Department of Corrections determined that Mr. Weinstein required immediate medical attention,” his attorney, Arthur L Aidala, said in a statement.
“They examined him and sent him to the hospital. It looks like he needs a lot of help physically. He has a lot of problems. He is undergoing all kinds of tests, he is a disaster from a health point of view”, added the lawyer .
Police said Weinstein was taken to New York’s Bellevue Hospital.
On Thursday, the city’s Court of Appeal found that the trial judge erred in admitting the testimony of other women who were allegedly abused by Weinstein but who were not named in the charges brought against him and ordered a new trial.
The accusations against the Oscar-winning producer exploded in 2017, sparking the MeToo movement, which paved the way for women to fight against sexual violence in the workplace.
Weinstein, 72, was convicted in 2020 in a New York court of rape and sexual assault against former actress Jessica Mann in 2013, and for forcibly performing oral sex on former production assistant Mimi Haleyi in 2006. Later , he was sentenced to 23 years in prison.
