The Court of Justice of the European Union (CJEU) should consider that some FIFA rules regarding player transfers may prove to be contrary to community law, recommends this Tuesday an advocate general of the institution.

At issue, according to a press release from the CJEU, is the obligation of the new club, together with the player, to eventually compensate the previous club in the event of a dispute over termination, which, the Advocate General considers, may be contrary to to EU rules on competition and also freedom of movement of people.

FIFA regulations, the lawyer indicates, restrict freedom of movement, on the one hand, and affect competition between clubs, on the other, by limiting clubs’ ability to recruit players.

At the origin of the case on which the CJEU was called to rule is the challenge, by a professional player, of the contractual rules between clubs and footballers, in the specific case of an unfair termination of a contract.

The player, who left Russian club Lokomotiv Moscow, claims the difficulty in finding a new club due to the demand for compensation for his departure and demands, in turn, the payment of outstanding wages.

The Advocate General’s recommendation is not binding on the court, but is followed most of the time.
