The Senate’s Economic Affairs Committee (CAE) approved, this Tuesday (19), the project that regulates the sale of gold with the aim of preventing the sale of metal extracted from illegal mining on indigenous lands. The project also concerns Conservation Units.

According to the text, commercialization is subject to the existence of mining ballast It’s from environmental ballast. The mining backing comprises the extraction of gold based on a regime established by the National Mining Agency (ANM). The environmental guarantee is proof that the gold was extracted from an area authorized by environmental licensing.

The project is authored by Senator Fabiano Contarato (PT-ES) and is in line with the proposal sent by President Luiz Inácio Lula da Silva to Congress in June last year, which called for regulation of the gold production chain in the country.

In addition to prohibiting the trade of metal from indigenous lands and conservation units, the project also ends the presumption of good faith in proving the origin of the product. According to the rule, created in 2013 and suspended by the Federal Supreme Court (STF) in April 2023, the legality of gold could be assumed solely based on the seller’s statements.

With the project, which goes to the Chamber of Deputies, the first sale of gold should take place only by the holder of the mining permit, which must be registered with the National Mining Agency (ANM), to a financial institution.

Furthermore, the seller will have to present the area’s environmental license It is issue invoice of product.
