The entrepreneur Fernando Sastre de Andrade Filho, 24 years old, investigated by the police as a suspect in causing an accident that killed an app driver 52 years old, on Sunday, 31, left the scene of the accident with the help of his mother nor was he later found at the hospital where he said he would be, according to the police report. Furthermore, according to the Estadão found, he did not take a breathalyzer test at the scene of the collision, which could indicate signs of drunkenness.
Carine Acardo Garcia, Andrade Filho’s lawyer, stated that she would not comment officially. “We’ll find out about the case and probably tell me today (Monday, 1st)“, he stated. According to the defender, her client is in a state of “shock” and will report to the police station.
Because of the episode, the São Paulo State Police ombudsman, Claudio Silva, told the Estadão that the body will contact the Military Police Internal Affairs this Monday to investigate the conduct of the agents. The Public Security Secretariat stated that it will investigate any procedural failures in the actions of the police officers.
In the incident report, police officers state that Andrade Filho’s mother went to Avenida Salim Farah Maluf, the location of the accident, and said she would take him to Hospital São Luiz, in Ibirapuera, south zone, to treat a wound in the mouth.
When the agents went to the hospital to take a breathalyzer test and collect their version of the accident, they found neither of them.
According to the police report, the police went to the driver’s house, but were unsuccessful. According to the document, Andrade Filho was never admitted to the hospital and, therefore, he is being sought by the police.
The businessman is being investigated for the collision of his luxury car, a Porsche 911 Carrera GTS, valued at more than R$1 million, into the back of another vehicle, a Renault Sandero, causing the death of app driver Ornaldo da Silva Viana.
The victim, aged 52, was rescued with a cardiorespiratory arrest and taken to Tatuapé Hospital. Viana died because of “multiple traumas”.
A Department of Public Safety states that “when responding to traffic incidents, the Military Police’s priority is to guarantee the rescue of victims and preserve the accident site – which was done by the PMs”, he says, in a note.
“At the time, in addition to the fatal victim, the driver of the Porsche, initially identified as the victim, and the passenger of the vehicle also had injuries and were rescued. The first, by his mother, while the second was taken by a Samu team.”
Civil police officers interviewed by the report under secrecy said that the military police took almost five hours to report the fatal accident to the police station.
The SSP states that the case was registered as manslaughter and culpable bodily harm while driving a motor vehicle and fleeing the scene of the accident after the police did not find Andrade Filho at the indicated addresses.
The ministry states that it will analyze the “dynamics of the occurrence to identify any errors in operational procedures”. The secretariat did not specify how long it took between the PM’s arrival at the scene and the incident being recorded.
