Tried for the death of Ângela Maria Santos Vieira, self-employed William Junior Moraes Guimarães, 27 years old, admitted that he drank three long necks of beer, but that he was not speeding above 70 km/h. However, when confronted with the expertise, he gave a confused answer. “No, I’m not going to contest the forensics, I was 70 km away from what I saw, but if the forensics said something else, I’m not going to contest it.”

Wiliam has been in prison since May 2023, accused of qualified homicide, for the death of his partner, Ângela Maria, and for the attempted murder of two other people, in a traffic accident that occurred on May 14 of that year, at 10:10 pm.

He was driving a Volkswagen Jetta along Avenida Mato Grosso, occupied by the couple and their friend, Francisco Romão Sampaio Nunes. According to the complaint from the MPMS (Public Ministry of Mato Grosso do Sul), at the intersection with Rua Dr. Paulo Machado, at high speed, he ran a red light and crashed into a Chevrolet Tracker, injuring the driver, Fernanda Giuncanse.

Ângela occupied the front passenger seat, exactly the side hit by the Tracker. She received treatment, but died at the scene. The passenger, who occupied the back seat, suffered minor injuries and was rescued. The driver of the Tracker suffered a fracture in her right forearm.

Crying a lot during the trial, William said he was on his way to his friend’s house, the third occupant of the Jetta, when the accident happened. The defendant claims that he passed when the light was still yellow when the collision occurred, contrary to what the investigation confirmed.

When answering questions from the judge of the 2nd Court of the Jury Court, Aluízio Pereira dos Santos, the defendant returned to talking about the dynamics of the accident. After the collision, he saw Angela lying on the bench. “Then I started trying to help, checking her pulse, her heartbeat, I saw that she was alive,” he said.

The defendant’s mother, Leila Moraes Guimarães, also gave a statement, calling for her son’s acquittal. “To make mistakes, everyone makes mistakes, those who have never made mistakes, those who have never drunk and driven, right? So I don’t think you have to take him to Christ and stone him, understand?” She added: “I’m sorry about Angela’s death, right? I’m truly sorry, but I’m sure it was never, ever his intention to commit such an atrocity, right?”

Prosecutor Bolivar Luís da Costa Vieira said that the expert recorded a speed of 81 to 86 km/h and Ângela Maria was not wearing a seat belt, highlighting that it is the driver’s duty to require all passengers to buckle up.

“The driver assumed the risk of resulting in death, injury, he assumed the risk with his own conduct, the risk of anything that could happen that night: killing a little dog that passed in front of him, running over an old lady who was in front of him there, hit a bicycle, hit a car, killed someone, which was the worst thing he could have done, he killed his own wife, he took the risk and that’s what the Public Prosecutor’s Office has been fighting against”, he stated.

According to the Public Prosecutor’s Office, Willian used means that resulted in a common danger when driving drunk, at excessive speed, also violating traffic lights and putting countless people at risk.
