A road freight transport company was ordered by the Labor Court to pay R$8 thousand for moral damage to a former worker who had to drive a truck without having a license. O man ended up involved in a traffic accidentwhich ended with the pile-up of several cars.

In the process, the driver claimed that the employer knew he did not have a driver’s licensebut he still had to perform the role from July 2021. In the same month the raid took place, where the vehicle he was driving lost its brakes.

According to the document, the worker said he felt harmed by the company’s conduct Camilo dos Santos It is who did not receive any type of assistance in the criminal process who began to respond after the accident.

Witness testimony was important in the process

When evaluating the case, the judge Martha Halfeld Furtado de Mendonça Schmidthead of the 3rd Labor Court of Juiz de Fora, agreed with the worker.

In the judge’s view, the testimony of a witnesswho stated that he had traveled the route with the driver several times and was present on the day of the accident.

According to the report, the man already left the company driving the truck. However, the witness learned that he did not have a driver’s license after police arrived at the scene of the raid.

O The company manager, in turn, stated in the process that another worker had been appointed to drive the truck and that the man should have gone as a helper. However, he was unable to say why the driver drove the vehicle on the day of the accident.

For the judge, it was clear that the company ordered the disabled worker to drive the vehicle to make deliveries.

On the other hand, the judge understood that Camilo dos Santos’ conduct does not remove the worker’s responsibility for the accident.

Therefore, he can respond according to what is determined by the police. Despite that, the worker will receive R$8,000, according to the decision.
