The Amazonas Public Defender’s Office (DPE-AM) filed a Public Civil Action (ACP) asking for a 30% reduction in ticket prices for the football game between Amazonas and Flamengo, in the third phase of the Copa do Brasil, which is scheduled to take place on May 22nd at Arena da Amazônia, in Manaus.
The action also requests the return of the difference in ticket prices to those who have already purchased them and the suspension of sales for a period of 48 hours, so that those responsible can adjust the ticket sales system and sell them again with the discount.
“We carried out an analysis of the prices charged and, in our understanding, these prices demonstrate an exorbitant and unjustified increase, which is prohibited by the Consumer Protection Code”, explained public defender Christiano Pinheiro.
“The Federal Constitution, when dealing with the economic order, establishes two principles, the principle of free enterprise, therefore economic freedom, and consumer protection, and no principle is absolute in our constitutional rules. Therefore, they must be harmonized and Therefore, we proposed the action, so that we can find a balance between making a profit by Amazonas FC and consumer protection, so that these prices do not prove to be abusive and exorbitant”, he added.
According to the civil action, Amazonas FC began selling tickets, through a digital platform, in an abusive manner, “as it charges prices that are completely outside the average for matches held in the State of Amazonas, when the games involve large clubs in the national football scene”.
The document points out that the cost of the most expensive grandstand ticket (R$400) is well above the average of (R$229.33) practiced in the last games held in Manaus involving major Brazilian football teams (Vasco, Santos and Flamengo ).
“The fact is that the defendant Amazonas Futebol Clube, taking advantage of a match against a national team, intends to charge ticket prices at abusive values that are completely dissonant with the market reality, if we compare large clubs on the national scene that played games here , including Flamengo itself”, highlights an excerpt from the civil action.
The action highlights that the club hosting the game, in this case Amazonas FC, has the right to establish ticket prices. “However, considering that no right and/or principle is absolute, each of them receives legitimate limitations arising from convenience with others, within the limits of consented freedom”, explained the DPE.
“The Public Defender’s Office and Consumer Protection bodies are not against making a profit, but this profit needs to be in line with our legislation so that the price is not too abusive for our consumers”, concluded defender Christiano Pinheiro .
