The Second Panel of the Federal Supreme Court (STF) formed a majority vote to maintain the arrest of Monique Medeiros, defendant for torture and murder of her son, the boy Henry Borel, who died in 2021 at 4 years old.

The ministers analyze in the virtual plenary an appeal by Monique’s defense against Minister Gilmar Mendes’ decision that ordered her arrest.

Mendes voted to reject the appeal. The minister considered that the defense did not present elements that justify the granting of house arrest or another alternative measure to prison.

Ministers Edson Fachin, Nunes Maques and Dias Toffoli followed Mendes’ understanding.

In his vote, Mendes recommended speed in Monique’s trial.

“Thus, no matter how complex the demand, it is necessary for the Judiciary to make the necessary efforts to conclude the trial phase, promoting strict compliance with the deadlines set out in the legislation. This stance will contribute not only to meeting relevant social demands, such as the implementation of Justice, but also to the observance of the right of the accused to a speedy and fair trial.”

  • Henry was in the apartment where his mother lived with former councilor Dr. Jairinho, in Barra da Tijuca, and was taken by them to the hospital, where he arrived already lifeless in the early hours of March 8, 2021;
  • The couple claimed that the boy had an accident at home and that he was “unresponsive, with his eyes rolled back and not breathing” when they found him in the bedroom;
  • But Henry’s autopsy reports and reconstruction in the then couple’s apartment rule out this hypothesis;
  • The document states that the cause of death was internal bleeding and liver laceration. [no fígado] caused by blunt action [violenta].
  • The police say that, weeks before he was killed, Henry was tortured by Jairinho. Monique knew;
  • Jairinho and Monique were arrested and are accused of double homicide, for trying to hinder the investigations and threatening witnesses.
