Alexandre Nardoni is released from prison after 16 years in prison for the death of his daughter Isabella

Sentenced to 30 years in prison for the death of his daughter Isabella, Alexandre Nardoni He won the right to serve the remainder of his sentence in freedom from the courts. He was imprisoned for 16 years and was granted progression to the open regime.

According to the Penitentiary Administration Secretariat (SAP), Nardoni left prison at 5:20 pm this Monday, the 6th, benefiting from a release permit issued by the Judiciary. The São Paulo Public Ministry informed that it will file an appeal to keep the defendant in prison longer.

In the decision, published this Monday, 6th, judge José Loureiro Sobrinho, from the Criminal Court of São José dos Campos, pointed out that Nardoni completed the time necessary for the progression of the regime. According to the judge, despite the Public Prosecutor’s notes, the seriousness of the crime committed by the defendant should not be an obstacle to his search for resocialization through regime progression. Nardoni was already in the semi-open regime, which gives the right to temporary trips to visit family.

The judge also highlighted the inmate’s good behavior, based on reports from the prison administration. He took into account that, during the temporary releases, the prisoner returned normally to the prison and did not register disciplinary offenses during the sentence, “thus fulfilling the objective and subjective requirements required by law to obtain the benefit”.

Psychiatric evaluations were favorable to regimen progression. Last month, Nardoni underwent criminological examinations and the reports stated that there was no contraindication for him to serve the end of his sentence in an open regime.

The judge recalled the conditions stipulated by law for Alexandre Nardoni to remain free for the remaining time of his sentence. These include: appearing quarterly at the Criminal Execution Court or at the Egress and Family Attention Center; obtain and prove lawful occupation within 90 days; remain at your residence between 8 pm and 6 am and do not change districts or cities without prior authorization from the judge.

Prisoners under an open regime cannot go to bars, gaming houses and other places incompatible with the benefit, under penalty of being returned to the more severe regime. Nardoni reached the time for progression to the open regime on April 6, but the MP opposed his going home citing the seriousness of the crime, considered heinous. He also asked that he be subjected to a new psychological evaluation, which was not accepted by the courts.

Lawyer Roberto Podval, who defends Nardoni, told the Estadão that he leaves prison “rehabilitated and ready to start his life over again”.

Remember the case

Alexandre Nardoni and his wife Anna Carolina Jatobá were accused and convicted of the death of his daughter and her stepdaughter, Isabella, on April 18, 2002. The girl, then five years old, was allegedly thrown from the sixth floor of the building where the family lived in Vila Guilherme, in São Paulo. The crime caused great repercussion.

Anna Jatobá was sentenced to 26 years and 8 months in prison, served 15 years and was promoted to the open regime in June last year. Alexandre was initially sentenced to 31 years and 1 month, but managed to reduce his sentence by around a year by working and studying in prison. He was promoted to the semi-open regime, with the right to temporary leave, in April 2019.
