Businessman Fernando Sastre de Andrade Filho was arrested this Monday, in São Paulo, more than a month after causing the accident that caused the death of app driver Ornaldo da Silva Viana, in the East Zone of the capital of São Paulo. Fernando was placed under preventive detention by the courts last Friday, following three requests from the police and the Public Prosecutor’s Office, and since then he has been considered a fugitive.

According to the Public Security Secretariat (SSP), Fernando surrendered to the police this afternoon and was provisionally detained at the 5th Sectional Police Station (East), where the arrest was registered. Afterwards, he will be sent to the custody hearing. GLOBO requested a defense statement and information from the São Paulo Court of Justice, but did not receive responses until the publication of this report.

Fernando Sastre is accused of qualified intentional homicide and very serious bodily injury, crimes that could lead to him serving a sentence of up to 20 years.

Remember the case

In the early hours of March 31, Sastre Filho was driving a Porsche at high speed along Avenida Salim Farah Maluf, in Tatuapé, when he collided with a car, causing the death of app driver Ornaldo da Silva Viana, 55 years old. The expert report carried out later showed that the businessman’s car had reached 156 km/h moments before the collision.

Military police responded to the incident, but released the businessman without requiring him to take a breathalyzer. A military police inquiry (IPM) investigates the conduct of the agents. The Civil Police requested Sastre Filho’s arrest twice, and the Public Prosecutor’s Office reiterated the request when filing the complaint on April 29. However, the Court denied the three requests, only reconsidering the situation last Friday.

The arrest was only ordered on May 3, when the MP-SP appealed to the Court of Justice, the second instance of the São Paulo Judiciary. Since then, the Civil Police had been looking for the businessman to comply with the arrest order, but he had not presented himself to Justice nor was he found at his address. Therefore, he was considered a fugitive.

On Monday morning (6), his defense filed a habeas corpus petition at the Superior Court of Justice (STJ). The case was distributed to Minister Daniela Teixeira, who has not yet decided.
