The São Paulo Court ordered Alexandre Nardoni to leave the prison in Tremembé, in the interior of São Paulo, where he was imprisoned after the murder of his daughter, Isabella Nardoni, in 2008. The decision was published this Monday (6) and Nardoni was released at 5:20 p.m. He must serve the remainder of the 31-year prison sentence he was sentenced to in an open regime.

According to the decision, progression to the open regime was requested by the defense and initially received an unfavorable opinion from the Public Ministry. Judge José Loureiro Sobrinho, however, considered that Nardoni maintains good conduct within prison, served more than half of his sentence and was taking advantage of temporary releases, returning without fail to the prison unit.

The judge orders the defendant to serve the remainder of his sentence at home, and must appear every three months at the Criminal Execution Court. Nardoni must remain at home between 8pm and 6am and can go out to work. He cannot go to bars, gambling houses or “other places incompatible with the benefit achieved”.

The Nardoni case

On March 29, 2008, Isabella de Oliveira Nardoni, then 5 years old, was thrown from the window of the building where her father, Alexandre Nardoni, lived with his wife, Anna Jatobá.

The couple even claimed that the crime was committed by an intruder in the apartment, but both were found guilty by the jury. Anna Carolina Jatobá was released in 2023, when she also progressed to the open regime. She left prison in June.

Prosecutor said it is ‘too soon’ for Nardoni to be released

Alexandre Nardoni does not admit to murdering his own daughter. In an interview with the True Crime blog, prosecutor Luiz Marcelo Negrini argued that the defendant should not go to the open regime because he still does not admit responsibility for the crime for which he was convicted. “It is a very serious crime for him to have the benefit of freedom now”, says Negrini.

He asked the court that Nardoni would only progress to the open regime after being subjected to the so-called Rorschach test, which measures an individual’s personality traits.

At the end of last month, the results of the third criminological examination that Nardoni carried out in Tremembé were released. The most curious excerpt from the new report, points out the True Crime blog, refers precisely to the defendant’s perceptions about his daughter’s murder: “The sentenced man demonstrates that he is aware of the seriousness of the incident. However, he does not express regret for something he did not commit. His feelings are of pain for the loss of his daughter. Over the years, he has filed appeals, bringing together new elements, some not considered, aiming to prove his innocence and reach the real culprit”, says a report signed by social worker Adriana Campos on April 19, 2024.
