The agency states that it provided the necessary steps in the caseas provided for by the Child and Adolescent Statute (ECA), but the Civil Police must determine whether there was negligence. The Municipal Department of Education said in a statement that the boy had not attended school for two months and that he reported it to the Guardianship Council more than a month ago. (see below).

The information was given to EPTV, a TV Globo affiliate. According to the agency, following an anonymous report of mistreatment, the counselors contacted the couple and they gave a statement at the unit. They were then referred to psychological care focusing on mental health.

Father Pedro Vitor Joseph do Prado and stepmother Camila Luiz Gomes da Silva, both 26 years old, were arrested. They must answer for triple homicide and torture. Both underwent a custody hearing during and were detained on a preventive basis.

The boy’s body was buried in the Municipal Cemetery.

The Guardianship Council reported that it provided all the referrals provided for by the Child and Adolescent Statute and that the father was notified for not adhering to the services offered.

He also highlighted that he requested a report from the school where Gustavo studied and that no evidence of abuse or neglect was found.

The agency claims that it strictly followed all protocols and regretted that there was not enough time for more incisive interventions.

Despite this explanation, the Vinhedo Education Department itself reported that Gustavo hadn’t attended school for more than two months. The fact was communicated to the Guardianship Council on the day March 22 and highlighted that possible negligence on the part of the agency is being investigated by the Civil Police.

The municipal administration said that, until the beginning of the year, teachers and school coordinators did not notice anything strange in the boy’s behavior. Furthermore, there is no record of a complaint with the Municipal Guard, only what was made on Monday.

The Public Security Secretariat was contacted, as was the Public Ministry, but there was no response. The Court of Justice informed that the process is being processed in secret.

Reports of ill-treatment

According to family members, Gustavo was abandoned by his mother, who had psychiatric problems. Initially he was under the care of his aunts, as his father served five years in prison for the crime of robbery. Later, the man got custody and the boy moved in with the couple about a year and a half ago.

During this period, reports of mistreatment emerged, as reported by Suelen Prado, the victim’s aunt. “I left the kid tied up. I tried over and over again, I called the council several times asking for help to get the kid out of there, to somehow get him out of that situation, but they didn’t do anything.”

A EPTV, a TV Globo affiliate, a family member reportedly said that there were at least seven complaints. The Guardianship Council denies: says he only received an anonymous report and made the referrals mentioned above. Delegate Denise Florêncio Margarido informed that she will investigate whether there was negligence.

To the police, the aunt reported that Pedro “got very nervous” and that she and her mother were locked in the house, without their cell phones. Meanwhile, he and Camila tried to flee the crime scene. When they realized that the couple was no longer there, the two women managed to leave and went to the police station.

Still according to the Civil Police, the suspects went to the capital of São Paulo, but returned to Vinhedo. They were located and arrested on Rodovia Miguel Melhado de Campos. At the police station, the father only said that “it wasn’t him” and that his son had fallen and hit his head.

Pedro and Camila will be charged with triple homicide and torture. This morning, the stepmother would be transferred to Paulínia (SP) and the father to Campo Limpo Paulista (SP), where they would undergo a custody hearing.
