The Figueira da Foz Court is trying a 47-year-old man who is accused of forging the signature of his father – who passed away at the age of 70 – on the day of his death in order to keep a BMW and not have to share it with the brother and the mother.
According to the indictment issued by the Public Prosecutor’s Office, to which our newspaper had access, the «accused completed the vehicle registration application where he indicated the reason for the transfer of ownership of the vehicle, a purchase and sale contract signed on the day of his father’s death. and he took care to place his father’s name in the place where the seller’s signature was signed by him and his name in the place of the buyer’. Both the examination carried out at the request of the Public Prosecutor’s Office and the man’s state of health – he died that day after a prolonged illness – prove that he could not have signed the document.
Also according to the accusation, the defendant delivered the aforementioned document to the Figueira da Foz Motor Vehicle Registry Office, two months later, to register the vehicle in his name, which would happen. «By completing the vehicle registration application, the defendant gave the appearance to the Registry services that that document corresponded to reality. The Registry, in turn, allowed the registration to be carried out, which it only consented to because the defendant’s actions created and established his conviction that the signature and that document corresponded to reality”, explains the MP magistrate.
Half a year later, the defendant sold the same BMW for around 14 thousand euros, a value that, therefore, did not form part of his late father’s inheritance.
The man, residing in Moinhos da Gândara and with no criminal record, is accused of committing a crime of document forgery in completed form and a crime of qualified fraud.
