UA Spanish insurance company was ordered by the Court of First Instance of Santiago de Compostela, Galicia, to pay compensation of almost 13 million euros to a family for “medical negligence” during a birth. This is the “highest amount granted to date in Spain for a case of this nature”.
According to the Europa Press news agency, the facts date back to 2015, when the mother went to the Rosaleda private hospital in Santiago de Compostela to give birth. However, due to the failure of labor induction and the attempt at a normal birth, “followed by a delay in the necessary surgical intervention”, “intrapartum hypoxia” occurred.
“Although the cardiotocographic record warned of hypoxia and, at times, it became threatening, it was not taken into account”, explained family lawyer Cipriano Castreje, who stated that the baby suffered “serious birth damage due to medical negligence.”
“As a result of the delay in carrying out a cesarean section that had been recommended a long time ago, the child was born with spastic cerebral palsy, absolute blindness, epilepsy, deaf-mute, mental retardation and severe multiple disabilities,” he added.
The lawyer criticized the position of the insurance company, which never recognized the child’s disability and “has not paid a single euro since the baby was born”.
