Alan Eugene Miller, the inmate who survived a lethal injection given in 2022, already has the date for his new – and second – execution scheduled.

According to documents that CBS had access to on Wednesday, the new execution will take place on September 26th. In addition to Miller surviving the execution in question – after being repeatedly “pierced” for 1h30 while lying on the stretcher – there is another controversial issue: the 59-year-old man will be executed using nitrogen gas .

Miller has been on death row since 2000, the year after he murdered two co-workers and another man. According to what witnesses explained at the time, Miller accused the three men of “spreading rumors” about him, without detailing what type of rumors they were. The court found that the crimes were committed in an especially heinous manner.

Nitrogen gas is not a debut, but almost

It is not the first time that nitrogen gas as an execution method has been used, having been used on Kenneth Smith last January. The 58-year-old man was also executed in this way in the US state of Alabama, after officials were unable to guarantee venous access to administer the lethal injection.

The way it happened was widely criticized, with the victim himself saying before he died that “Alabama took a step back from humanity.”

Kenneth Eugene Smith was executed on Thursday using an unprecedented and highly controversial method. Contrary to what the judicial authorities had assured, those who witnessed the moment claim that the inmate suffered for a few minutes, breathless and in agony.

The execution was also criticized by the United Nations, as well as the European Union.

In Miller’s case, he thus becomes the first inmate to ask to be executed in this way, with the authorities giving the ‘green light’ for the situation.

The death penalty no longer happens in many countries, however, not all convictions end up being carried out. Remember the most controversial cases here of executions that did not take place and where, until the last, the detainees heard that their sentence was “suspended”.
