The Federal Court made public this Friday the recording of Robinho’s custody hearing, held on Thursday, shortly after the former player was arrested in Santos for the crime of rape committed in 2013, in Italy.

The hearing lasted just over three minutes and was held virtually by judge Mateus Castelo Branco Firmino da Silva, with the former player without handcuffs.

Robinho was accompanied by lawyer Sérgio Henrique Cotrim Moliterno Júnior. The hearing was also attended by prosecutor Felipe Jow Namba.

Castelo Branco questioned Robinho about the conditions under which he was arrested.

– I volunteered to go there (to the Federal Police) – said the former player, who ended up arrested at home, on Thursday, after the court order.

At the hearing, Robinho denied having suffered mistreatment during the operation. He also confirmed that he is in good health and that the three children will stay with their mother.

Asked about a relative who has a serious illness, the former player replied that it was the case of his father, who lives with him.

Prosecutor Felipe Namba did not ask Robinho any questions, nor did the former player’s lawyer.

The judge then closed the hearing, ordering Robinho to undergo a criminal examination and begin serving his sentence.

The former player was arrested after a decision by the STJ (Superior Court of Justice), on Wednesday, which approved the Italian sentence that sentenced him to nine years in prison for the crime committed in 2013.

Robinho appealed to the STF (Supreme Federal Court), but was denied an injunction in a Habeas Corpus request by Minister Luiz Fux. The defense will insist on a new appeal, but it is expected that it will only be analyzed after Easter.

Robinho’s lawyers maintain that the former player has the right to wait in freedom until the STJ decision has become final – when it is no longer possible to appeal. In addition to Habeas Corpus, the defense intends to question the approval in the higher court and admits that it may take the case to the STF afterwards.

Robinho was convicted in three instances of the Italian Court for the group rape of an Albanian woman, in 2013. The definitive decision, from the 3rd Criminal Section of the Supreme Court of Cassation, in Rome, is from January 2022, when the athlete had already returned to Brazil.

At the end of the same year, the Italian Ministry of Justice sent a request for Robinho’s extradition, which was denied by the Government – ​​the country does not extradite its natural citizens. Subsequently, the Italians contacted the STJ to have the sentence approved to take effect in Brazil.

This was the request analyzed by the Special Court of the STJ. Brazilian justice does not discuss the merits of the Italian action, which condemned Robinho. The former player claims that the relationship was consensual with the woman and denies rape.

The crime took place in January 2013, at the Sio Café nightclub, in Milan. According to the investigation, Robinho and five other Brazilians participated in the act. In addition to the former player, another Brazilian, Ricardo Falco, was sentenced to the same nine years in prison.

Falco is also the target of a request from Italy to serve his sentence in Brazil. The case against him at the STJ has not yet been scheduled for trial.
