Portugal is one of the countries against which the European Commission decided to initiate infringement procedures, by sending notices to comply, because they have not yet designated their digital services coordinators under the Digital Services Regulation or because such designation has not yet been complemented by sufficient enabling powers. Member States had to fulfill these obligations by 17 February 2024. To date, the EstoniaThe Poland and the Slovakia have not yet appointed their digital services coordinators.

Furthermore, despite having designated their digital services coordinators, CyprusThe Czechia It is Portugal They still have to grant them the necessary powers and competencies to carry out their functions, including the imposition of sanctions in case of non-compliance.

The existence of fully qualified digital services coordinators in each Member State is essential for the exercise of the new rights created under the RSD, namely to ensure that users can lodge complaints in their place of residence against platforms, grant flagger status trust and empower investigators.

Consequently, the Commission decided to send formal notices to the six Member States, which have two months to respond and close the gaps mentioned by the Commission. In the absence of a satisfactory response, the Commission may decide to issue a reasoned opinion.
