São Paulo – The First Panel of the Federal Supreme Court (STF) formed a majority vote this Monday (25) to confirm the decision of Minister Alexandre de Moraes that led to the arrest of three suspects of planning and ordering the murder of councilor Marielle Franco (PSOL-RJ), in 2018.

In addition to Moraes, ministers Cármen Lúcia, Cristiano Zanin and Flávio Dino also voted for the arrests and other precautionary measures determined in the operation launched this Sunday (24) against those being investigated. Minister Luiz Fux’s vote is still missing.

The analysis ends at 11:59 pm this Monday, but it is likely that the score will be defined sooner.

Domingos Brazão, Chiquinho Brazão and Rivaldo Barbosa were arrested in Rio de Janeiro, this Sunday, and were detained after a custody hearing.

Still on Sunday, they were transferred to Brasília and sent to the federal penitentiary in the Federal District.

In addition to the arrests, Moraes’ decision also determined the removal from public duties of delegate Giniton Lages and commissioner Marco Antônio de Barros Pinto. Both worked at the Rio Homicide Police Station at the time of Marielle’s murder.

Giniton was the delegate who began investigating the case, appointed by the then head of Rio’s Civil Police, Rivaldo Barbosa, who was arrested this Sunday. He is suspected of not only having covered up the crime, but also of having endorsed the murder.

Chamber

This Monday, the president of the Chamber of Deputies, Arthur Lira (PP-AL) is expected to put the analysis of Chiquinho’s arrest to a vote in the plenary.

As a parliamentarian, the arrest must be endorsed by the Legislature – just as happened with Bolsonarista Daniel Silveira (PTB-RJ).

The Constitution provides that deputies and senators are inviolable civilly and criminally for opinions, words and votes, and can only be arrested in the event of a non-bailable crime. In these cases, parliament is notified within 24 hours to make a decision.

The expectation is that the Chamber will ratify the Court’s decision and maintain the arrest of Chiquinho Brazão, who this Sunday was expelled from União Brasil.

The decision, informed by the party’s general secretary, ACM Neto, took place after a virtual meeting of the National Executive. Chiquinho Brazão, through his defense, would not have spoken out.

To be confirmed, the arrest must be ratified by an absolute majority of deputies, obtaining at least 257 votes in favor.

Before going to the plenary, the case must be analyzed as a matter of urgency by the Constitution and Justice Commission (CCJ), led by Bolsonarist Carol de Toni (PL-SC).
