The collision, which also involved the app driver’s Renault Sandero, occurred in the early hours of the 31st on Avenida Salim Farah Maluf, in Tatuapé, east of São Paulo. In addition to Viana’s death, the accident resulted in the hospitalization of a friend of Andrade Filho, who underwent a surgical procedure to remove the spleen. He was next to the businessman in the Porsche.

The case is investigated by the 30th Police District (Tatuapé). The São Paulo Public Prosecutor’s Office (MP-SP), which is monitoring the incident, stated that the average speed report produced by the Technical-Scientific Police indicates that the vehicle was traveling at more than 150 km/h “just before the accident”. The agency informs that it also requested 3D scanning expertise to elucidate the accident in detail.

The accident was recorded in the early hours of Easter Sunday, but Andrade Filho reported himself to the 30th DP, east of the capital, almost 40 hours after the incident on April 1st – the same day that Viana was buried in Guarulhos, in Greater São Paul.

The businessman was indicted for the crimes of homicide, bodily harm – due to the injuries caused to his friend – and fleeing the scene of the crime (he did not provide assistance and did not take a breathalyzer).

A São Paulo Court denied the two arrest requests filed by the Civil Police and the Public Ministry against the businessmanwhich responds to the process freely.

One of the points that supported the last request for arrest made by the Civil Police, on the 6th, is that Andrade Filho appeared to be “altered” that morning, according to witnesses interviewed during the investigation. Alcohol intake is still being investigated, but the suspicion raised the alarm among investigators.

“Witnesses say he had a slurred voice and a staggering walk,” said delegate Carlos Henrique Ruiz, from the 5th Sectional Police Station (East). According to an investigation by the Military Police, the agents who responded to the incident erred by not performing a breathalyzer test on Fernando after the accident. He was at an “open bar” party before the accident.

As shown by the Estadão last week, police chief Nelson Alves, who was in charge of investigations into the accident, was transferred from the 30th Police District and left the case. For the position of Alves, who now assumes the 81st DP (Belém), delegate Milton Burguese was chosen.

The Public Security Secretariat denies that the authority has been removed from the district and justifies the change as an “administrative change”. According to the ministry, delegate Burguese went to the 30th DP because he had experience in investigating crimes against the financial system and money laundering.
