Gabriel case: Court files case against PMs indicted for coercing man to confess to murder in RS | Rio Grande do Sul

The Public Prosecutor’s Office (MP) considered that the police entered the man’s property because he was considered a fugitive and that the interrogation, despite having violated operational procedures of the Military Brigade (BM), did not constitute an abuse of authority.

In December 2022, the general commander of the BM, Colonel Claudio Feoli, decided to indict the police officers. The Internal Affairs Department stated that the way the police officers conducted the interrogation did not find legal support and that the police officers violated fundamental rights provided for in the Constitution.

At one point in the investigation, the colonel stated that one of the police officers approached the man and told him to answer questions about Gabriel’s death “in accordance with the agreement they had.” In another excerpt, a police officer reportedly said that he knew the man was capable of killing Gabriel. The man, in one of the videos attached to the investigation, asks to be shot so that the interrogation can be ended.

Gabriel Marques Cavalheiro was an 18-year-old young man who moved from Guaíba, where he lived with his parents, to São Gabriel, where he would perform his mandatory military service. The young man was staying at his uncle’s house, but his sister also lived in the city.

The police allegedly attacked Gabriel, who was immobilized and taken into a military vehicle. Witnesses said he was hit by “at least two or three baton blows.” That was the last time Gabriel would have been seen alive.
