After the São Paulo court released Alexandre Nardoni, convicted of involvement in the death of his own daughter, Isabella Nardoni5 years old, the girl’s mother, Ana Carolina Oliveiraclassified the decision as being “absurd”. Imprisoned for 16 years, the man had progressed to the semi-open regime in 2019, and since Monday (6) he has been serving a 30-year sentence in freedom.

The victim’s mother defined the judiciary’s opinion as “unfortunate”in an interview this Tuesday (7) on the Morning Show, on Young pan.

My daughter is not coming back, and he is completely free to do what he wants, to continue his life, to be out there on the streets, just like me, just like you. So, it’s painful for those in the family, it’s sad, it’s regrettable to see that our justice system allows this to happen.”

On the occasion, Ana Carolina spoke about the possibility of meeting Alexandre or Anna Carolina Jatobá — ex-wife of Isabella’s father and also convicted of involvement in the girl’s death —, as both are serving open sentences.

“Knowing that I can walk down the street and meet her, knowing that the person who killed my daughter is there, free. And my daughter will never come back. I will never have this privilege of being able to go to her graduation”, he lamented.

The girl’s mother also questioned the possibilities provided by law that allow regime progression, and also argued that those convicted of Isabella’s death should serve the full sentence in a closed regime.

Regrettable, absurd. I think that today the least we have to do, which is my fight, which is what I think and idealize, you got a sentence, you need to serve it, at least the period for which you were sentenced.”

MP appeals decision

The Public Ministry of São Paulo (MP-SP) filed an appeal against the court decision that allowed Alexandre Nardoni to be released from prison in compliance with the open regime. The agency also filed precautionary measure, with suspensive effect, in which it requests the defendant’s immediate return to the semi-open regime in prison, until the appeal is judged. The man’s defense said he will act to “avoid any injustice.”

Sentenced to 30 years in prison for the death of his daughter, Isabella, the accused left the Tremembé penitentiary late Monday afternoon.

The MP-SP filed an appeal against the execution on Monday, at the State Department of Criminal Execution of the 9th Administrative Region, in São José dos Campos, alleging that the defendant did not fully prove that he did not pose a risk to the society.

The prosecutor’s office in the case considers that Nardoni committed a “heinous, barbaric crime by killing his 5-year-old daughter, demonstrated emotional coldness, marked insensitivity, a clearly concealed character and a lack of repentance.”

The document also cites psychiatric indication that the defendant has “latent impulsivity”as well as exhibiting elements of personality disorder.

The Public Prosecutor’s Office argued for the suspension of progression to the open regime, with Nardoni maintained in an intermediate regime and submission to the Rorschach test and an in-depth and conclusive psychiatric examination, which can ascertain possible personality disorder and the possibility of progression to the open regime.

The Rorschach test, popularly known as the “inkblot test”, is a psychological assessment technique that consists of giving answers about what inkblots look like presented on boards with symmetrical lines. From the answers, it would be possible to obtain a broad picture of the psychological dynamics of the individual tested.

REMEMBER THE CASE

Alexandre Nardoni and his then wife Anna Carolina Jatobá were accused and convicted of the death of his daughter and stepdaughter, Isabella, who died in March 2008.

The girl, then 5 years old, was allegedly thrown from the 6th floor of the building where the family lived, in Vila Guilherme, in São Paulo. The crime caused great repercussion.

Anna Jatobá was sentenced to 26 years and 8 months in prison, served 15 years and was promoted to the open regime in June last year.

Alexandre was initially sentenced to 31 years and 1 month, but managed to reduce his sentence by around a year by working and studying in prison.

He was promoted to the semi-open regime, with the right to temporary leave, in April 2019.
