Daniel Alves gets parole on bail of 1 million euros

Daniel Alves will turn to Neymar’s father to pay bail of 1 million euros (R$5.4 million) in exchange for provisional release, according to the Spanish newspaper “La Vanguardia”. According to the publication, the former player is not expected to be released from prison this Wednesday (20), as the deadline for depositing bail in the court secretariat’s account expired at 2pm local time (10am Brasília time).

The Barcelona court accepted this Wednesday the request for provisional freedom made by the defense of the former Brazilian player, convicted in Spain, in February this year, of raping a woman in the bathroom of a nightclub. The provisional release granted upon payment of bail is valid until a definitive sentence has been given.

O g1 He sought advice from Neymar and his father, who said he would not speak about the case: “At the moment we have no comments to make on the matter.”

According to the Catalan newspaper “El Periodico”, people linked to Daniel Alves claim that the defense did not expect such a high figure for bail. For this reason, the lawyers would be turning to family and friends, and Neymar’s father would have been one of those contacted – he had already given Daniel Alves the 150 thousand euros in compensation for the victim, which resulted in the reduction of the sentence in the first instance.

Victim’s lawyer says she is ‘surprised and outraged’

In February, Alves was sentenced to four and a half years in prison for the crime of sexual assault — he was accused of raping a woman in a nightclub in Barcelona. The defense appealed the sentence and, subsequently, asked that the Brazilian await the final deliberation in freedom.

The ruling also determined that:

  • He is obliged to maintain a distance of at least 1 kilometer from the victim’s residence, her place of work or any other place she frequents — the young woman is from Barcelona and also lives in the Catalan capital;
  • Daniel Alves cannot attempt to communicate with the complainant through any means;
  • You cannot leave Spain;
  • You must appear at the Barcelona Court weekly or as often as requested.

Mitigation by repair

The February sentence that convicted Daniel Alves of rape determined only half of the nine years in prison that the Spanish Prosecutor’s Office requested — the prosecution had asked for the maximum sentence in these cases, 12 years.

The court, however, determined four and a half years in prison because it applied a mitigating factor to the former player due to the fact that the player had paid, before the sentence, the amount of 150 thousand euros (R$ 801.2 thousand) to the victim. The amount, determined in a previous provisional sentence, expressed, according to the court, “a reparative desire”.

The 150 thousand euros paid by Daniel Alves to the court were donated by Neymar’s family, according to information from the newspaper O Globo. To g1, Neymar’s advisors said at the time that they would not comment. Neymar has been helping Daniel Alves financially and legally since January this year. Alves has been without access to his assets since he was arrested in January 2023.
