Suzana Garcia was on the Goucha program to comment on the case of Mafalda, a woman who claims the inheritance that her uncle left to her nephew’s wife. With no children and no parents, this man left the woman in his will, but the family claims dementia. Now, lawyer Suzana Garcia explained that direct heirs without parents, without children and without a partner, have their brothers or nephews as heirs on behalf.

However, the lawyer explained that even with a will, the inheritance cannot be removed from the legitimate heirs. Even if the deceased does not want to allocate a share of the inheritance to these heirs, the law requires him to do so, since at the time of the will only one third of the available assets can be donated.

note: The legitimate heirs – and, therefore, with the right to legitimate inheritance – are the spouse, descendants and ascendants.
