The four Portuguese men suspected of raping two women in Spain, in 2021, are in Portugal awaiting the trial that could take place this year, although the defense does not yet know the accusation, the lawyer told Lusa.

The case took place on July 24, 2021, when four Portuguese men were arrested for alleged rape and sexual abuse of two women aged 22 and 23, in a guesthouse in Gijón, in northern Spain.

Two of the suspects were released and returned to Portugal, while the others remained detained in the Asturias penitentiary center, after the judge ordered their preventive detention, on July 26, without the right to bail.

Speaking to the Lusa agency, the lawyer for the detained Portuguese, Germán Inclán, stated that the four are currently in Portugal, and all of them are accused of these violations.

They are free in Portugal and “await the start of the trial in Spain”.

“They are as well off as a person can be when they are wrongly accused of something they did not commit. They live in a small town and their neighbors look at them sideways, because deep down they are also condemning them in advance,” she said.

The defense hopes that the trial will be scheduled for this year, but Germán Inclán adds: “It doesn’t depend on us.”

“We are awaiting the accusations from the Public Prosecutor’s Office and the private prosecution so that we can later present our defense,” he said.

And he accuses: “The current Spanish legislation on the matter is true nonsense, because it is subjugated not to objective criteria of justice, but to values that emanate directly from the ‘woke’ ideology. [alerta para certos assuntos sociais] and more radical communist”.

“In practice, there is currently no true presumption of innocence for men in these types of sexual crimes. The Constitution guarantees it, but the laws that are being approved by the legislature completely and completely violate it”, he continued.

The lawyer also accuses the media in Spain and Portugal of having “lynched” the four Portuguese, condemning them for the “’crime’ of being men and without waiting for a fair trial”.
