Chamber analyzes arrest of deputy Chiquinho Brazão

Marielle and her driver were shot to death on March 14, 2018. A PF investigation concluded that federal deputy Chiquinho Brazão and his brother, Rio de Janeiro Court of Auditors advisor Domingos Brazão, were the masterminds of the crime.

According to a PF report, Marielle’s death was engineered by the Brazão brothers as a reaction to the councilwoman’s actions against a land allotment scheme in militia areas in the West Zone of Rio, the electoral stronghold of Domingos and Chiquinho.

The Federal Police’s conclusions take into account the testimony of Ronnie Lessa, a former military police officer accused of being one of the perpetrators of the attack.

Lessa is already detained. In addition to him, former PM Élcio de Queiroz, another suspect of carrying out the crime, is also under arrest.

According to the Constitution, arrests in the act of parliamentarians in office must be submitted to the Chamber (in cases involving deputies) or to the Senate (in cases involving senators).

Initially, the advice of the President of the Chamber, Arthur Lira (PP-AL), indicated that the analysis of the arrest would be submitted directly for discussion in the main plenary of the House, due to the urgency of the matter.

This Monday (25), upon arrival of the arrest report to the House, a procedure was adopted that submits the measure for consideration by the CCJ, following the Chamber’s internal regulations.

At the collegiate, an opinion will be presented by the rapporteur, deputy Darci de Matos (PSD-SC), who will be able to give his opinion on maintaining or revoking the effects of Moraes’ order. The opinion will need to be approved by a majority of those present. It will then be sent to the main plenary of the Chamber.

There, deputies can decide whether or not to maintain the measure. 257 votes are needed to maintain or revoke (absolute majority of members of the Chamber), in an open and nominal vote — when each parliamentarian’s votes are announced. The date for the measure analysis session has not yet been defined.
