Chamber pays homage to Marielle and Anderson and decides on the arrest of the person responsible for the murder

The session was scheduled before the operation on Sunday (24), which arrested suspected perpetrators of the crime. One of them is deputy Chiquinho Brazão, whose arrest is being analyzed by the House as of this Tuesday (26)

The Chamber of Deputies held, this Tuesday (26), a solemn session in honor of Rio de Janeiro councilor Marielle Franco (PSol) and her driver, Anderson Gomes, executed in an ambush in the center of Rio de Janeiro in 2018, on March 14 2018.

Therefore, 6 years ago Marielle and Anderson were murdered. And only now, the likely perpetrators of the murder have been arrested preventively.

Last Sunday (24), three people were arrested accused of being the masterminds of the crime, including federal deputy Chiquinho Brazão (RJ), who was a Rio de Janeiro councilor at the time. Hours after the arrest, the National Executive of União Brasil expelled the deputy from the party.

TRIBUTES

The session, opened with a performance by the female percussion group Batalá Brasília, responded to the request of PSol and PT parliamentarians, and had already been scheduled before the PF (Federal Police) operation, which arrested, last Sunday (24), three accused of ordering and engineering the deaths of Marielle and Anderson.

Also this Tuesday, the House begins to discuss and must decide whether to maintain or revoke the arrest of federal deputy Chiquinho Brazão (No Partido-RJ), identified as one of the masterminds of the crime.

Parliamentarians from PSol, PT, PCdoB, PSB and representatives of social movements and the executive director of the Marielle Franco Institute, Lígia Batista, participated in the tribute.

The Minister of Racial Equality, Anielle Franco, the councilor’s sister, and members of the councilor’s family were not present.

SENDER

Marielle and Anderson were shot to death on March 14, 2018. The PF investigation concluded that federal deputy Chiquinho Brazão and his brother, the counselor at the Rio de Janeiro Court of Auditors, Domingos Brazão, were the perpetrators of the crime.

The two were preventively arrested on Sunday. In addition to the Brazão brothers, the former head of the Rio Civil Police, delegate Rivaldo Barbosa, was also detained by the PF. He is accused of masterminding the execution.

According to a PF report, Marielle’s death was engineered by the Brazão brothers as a reaction to the councilor’s alleged actions against a land allotment scheme in militia areas, in the West Zone of Rio, the electoral stronghold of Domingos and Chiquinho.

The PF’s conclusions take into account the testimony of Ronnie Lessa, a former military police officer accused of being one of the perpetrators of the attack.

Lessa is already detained. In addition to him, former PM Élcio de Queiroz, another suspect of carrying out the crime, is also under arrest.

CHIQUINHO PRISON

The CCJ (Constitution and Justice Committee) of the Chamber will begin, this Tuesday, the analysis of the arrest order of deputy Chiquinho Brazão, determined by the minister of the STF (Supreme Federal Court), Alexandre de Moraes.

According to the Constitution, arrests in the act of parliamentarians in office must be submitted to the Chamber — in cases involving deputies —, or to the Senate — in cases involving senators.

Initially, the advice of the president of the Chamber, Arthur Lira (PP-AL) indicated that the analysis of the arrest would be submitted directly for discussion in the main plenary of the House, due to the urgency of the matter.

This Monday (25), upon arrival of the arrest report to the House, the procedure was adopted that submits the measure for consideration by the CCJ, following the Chamber’s internal regulations.

RITE

At the collegiate, the opinion will be presented by the rapporteur, deputy Darci de Matos (PSD-SC), who can give his opinion on maintaining or revoking the effects of Moraes’ order.

The opinion must be approved by a majority of those present. It will then be sent to the Chamber plenary.

In the plenary, deputies can decide whether or not to maintain the preventive measure. Due to the seriousness of the facts, the rapporteur will certainly offer an opinion in favor of maintaining the STF’s decision, that is, for the continuation of preventive detention.

257 votes are needed to maintain or revoke — an absolute majority of members of the Chamber —, in an open and nominal vote — when the votes of each parliamentarian are announced. The date for the measure analysis session has not yet been defined.
