Miguel case: jury of mother and stepmother accused of boy’s murder begins this Thursday

The mother of the boy Miguel dos Santos Rodrigues and her ex-partner will go to trial this Thursday, at 9 am, at the Foro de Tramandaí, on the North coast. They are accused of the death of the seven-year-old child, which occurred in 2021. The trial is expected to last two days.

The date was set by judge Gilberto Pinto Fontoura, from the 1st Criminal Court of the District of Tramandaí, after the defenses’ appeals against the decision had been exhausted. The defendants will answer for the crimes of torture, qualified homicide and concealment of a corpse.

It was the child’s stepmother who revealed the facts to the Civil Police. She alleges that her ex tortured and killed the victim. Miguel’s mother, however, remains silent. The police say they located messages and photos indicating the participation of the two, who have been in preventive detention since then.

The crime occurred in Imbé. According to the Public Ministry of RS (MPRS), between April 17th and July 25th of that year, the two women subjected the boy to intense physical and mental suffering, as punishment for the fact that the child sought affection, care and attention.

The prosecution maintains that Miguel was locked, with his hands tied and immobilized with chains and padlocks, inside a small wardrobe for long periods during one of the days in which he was a victim of the defendants. If he managed to free himself, the women tied him up again.

According to the complaint, Miguel was forced to eat only when the women wanted, in the same way that he was forced to do his physiological needs inside the furniture, including being forced to clean it as punishment. The boy also went through mental and emotional suffering, being forced to repeatedly write derogatory phrases against himself in a notebook, such as “I’m an idiot”, “I’m a thief”, “I’m bad”, “I’m cruel ”, “I’m evil”, “I’m no good”, among others.

The homicide, alleges the MP, was completed between the 26th and 29th of July 2021. The child’s death was due to physical aggression, insufficient food, use of inappropriate medication and failure to provide health care to the victim. Miguel also had his head thrown by his mother against a wall, with such violence that a tile broke on impact.

The jury will be made up of seven people. “We aim for a sentencing decision that provides a satisfactory outcome to these barbaric crimes committed against a seven-year-old child, murdered by her mother and her partner, inside her home”, highlighted prosecutor André Tarouco, responsible for the complaint.

In the accusatory piece, Tarouco states that the crime was committed for a base reason, as the defendants, who were in a romantic relationship with each other at the time of the incident, demonstrated total contempt for the victim, blaming her for damaging the relationship, being considered an obstacle to the which they assumed would be the couple’s happiness. The crime was also committed by cruel means, as they, after intense attacks on the victim and application of medication, deprived her of adequate medical care, which caused her unnecessary suffering.

Furthermore, the MP states that Miguel was physically and psychologically weakened, being forced to take medications that were inappropriate for a child, and not having the strength to react and scream for help when faced with the attack from two adults.

Finally, regarding the concealment of the corpse, the prosecutor says that the couple, on July 29, 2021, broke the joints of the lower and upper limbs of the victim’s body and placed her in a fetal-like position, inside a suitcase. on a trip. Then, they took the body out of the suitcase and threw it into the Tramandaí River. The boy’s corpse was never found.
