The National Human Rights Council announced this Tuesday the reopening of the investigation into the murder of former deputy Rubens Paiva.

The reopening of the investigations was approved by 6 votes and one abstention — counselor Roseli Faria, representative of the Ministry of Justice and Public Security, said she had not been advised on the matter.

Counselor André Carneiro Leão will report the case to the council. The next step is to define the working group to continue the investigation and establish deadlines.

At the end of the work, the results of the investigations into what happened to Rubens Paiva and the process will be forwarded with recommendations to the Public Ministry or Federal Police, if applicable.

Rubens Paiva, engineer and politician, was detained by agents of the military regime on never proven charges of subversion and disappeared into the hands of the State.

His case became one of the most symbolic of the fight against impunity for crimes committed during the leaden years, a period marked by systematic human rights violations, including torture, murders and forced disappearances.

In the section about Paiva, the final report of the National Truth Commission (CNV) concluded that he “was killed and disappeared when (…) he was under the custody of the Brazilian State, in a context of systematic human rights violations promoted by the dictatorship military, implemented in the country from April 1964, with the official version released at the time of the events remaining deconstructed.”

Criticism of the government’s silence

During the session, the representative of the Brazilian Bar Association (OAB), counselor Hélio Neto, criticized in his vote President Lula’s guidance not to remember the 60th anniversary of the military coup.

“The recent statements by President Luiz Inácio Lula da Silva that the civil-military coup of 1964 would be ‘history and that he does not want to dwell on the past’, advising that there should not be, as there was not, any remembrance in the spheres of government of the coup d’état and its crimes, on the occasion of his sixtieth birthday, on March 31st, thus pretexting to promote pacification with the military element, highlights the setback and limitations imposed by the events of January 8th on the resumption of the state policies of Truth, Memory, Justice and Reparation”, said Neto.
