The National Consumer Secretariat (Senacon), of the Ministry of Justice and Public Security (MJSP), notified on Tuesday (23), the company GOL Linhas Aérea SA so that within a period not exceeding two days, counting from receipt of the document, provide clarification on the report of the death of a golden retriever dog, during air transport by GOLLOG, a GOL company, after an error in the destination, on the 22nd of this month.

In the assessment of the National Consumer Secretary, Wadih Damous, “A situation like this requires investigation in detail and cannot be ignored. We cannot accept that such situations continue to happen”, he stated.

One of the clarifications requested concerns the methodology and policy for transporting animals by the company, in addition to information on the repair procedures in this case.

In the notification, Senacon highlights that its role is to ensure the protection and exercise of consumer rights, in accordance with the principles, rights and guarantees set out in the Consumer Protection Code (CDC), in particular the principle of consumer vulnerability.

Another measure to be taken by Senacon is the request to the National Civil Aviation Agency (ANAC) to participate and monitor all procedures that will be initiated by the agency regarding the case.

ANAC also notifies the company to provide clarification about the animal’s death. Furthermore, the Agency reported that it had initiated administrative proceedings to determine the reasons that led to the death of the dog Joca on flight G3-1527 between Fortaleza Airport (CE) and Guarulhos (SP).

Understand the case

A dog named Joca, five years old, a large golden retriever breed weighing 47 kg, died during air transport by GOLLOG, a GOL company, after an error at the destination, on Monday (22). The pet should have been taken from Guarulhos International Airport, in São Paulo, to Sinop (MT), but was mistakenly placed on an aircraft that boarded for Fortaleza (CE).

The animal ended up being sent back to Guarulhos and when the owner arrived to find it he was already dead. According to the owner, the veterinarian had given a medical certificate indicating that the animal would survive a two and a half hour trip, but with the error, Joca could not survive the almost 8 hours on the plane.

Regulation

The National Civil Aviation Agency (Anac) does not regulate the air transport of animals, except guide dogs, which are governed by Resolution 280, of 2013. The standard ensures that the guide dog is placed in the cabin next to the passenger with impaired vision.

Each airline has a transport rule that specifies the size and weight for the animal to travel in the cabin or cargo compartment of the plane. Companies must inform, in advance, their standards and the conditions necessary for transport, ensuring safety for passengers, crew and the animal itself.

Standards

According to the Brazilian Institute of Geography and Statistics (IBGE), almost 48 million households in the country have dogs or cats. Today’s families are multispecies, a term that designates bonds not only based on kinship, but on affection. And animals are included in this.

The number of pets transported on planes in the country is also high. Therefore, investigating possible mistreatment or non-compliance with animal health and safety standards is essential, especially at this time. “Not only to clarify the facts, but also to ensure that they are transported safely throughout the journey. And, for all these reasons, we will recommend that Anac regulate the transport of pets and we will also request Senacon’s participation in drafting the resolution”, says Wadih Damous.
