DECO proposals to amend the Travel Directive

The Travel Directive, in force since 2018, revealed failures in the response to critical episodes such as the Covid 19 pandemic and the insolvency of large operators. Now, the Commission has presented a proposal for amendment and DECO highlights what must be modified to guarantee consumer protection.

The Directive on organized travel and related travel services sought, in light of market developments, to adapt the scope of protection for travelers, bearing in mind that these services are increasingly contracted through digital channels and are not limited to pre-arranged travel arrangements. -traditional organized.

Despite being an important consumer protection instrument, the Directive was based on an extremely complex set of definitions and some moments of particular difficulty, such as the Covid 19 pandemic, revealed gaps and the need to change and clarify some rules.

The European Commission recently presented a proposal to amend the Directive, seeking to clarify some essential aspects related, for example, to the possibility of canceling the contract free of charge, in case of extraordinary circumstances, but leaves out important elements, such as the need to introduce contractual liability rules for related services.
