In the accident with the secretary of Nova Odessa, the horse invaded the lane where the victim was traveling in the vehicle in the company of the city’s mayor, Cláudio Schooder, aka Leitinho (PSD), who is hospitalized with minor injuries. – Read more about the accident below, in the report.

In addition to passenger vehicle, two trucks also hit other horses on the track. The animals died.

Law No. 10,406, of January 2022, establishes that “the owner, or holder, of the animal will compensate for the damage caused by it, if the victim’s fault or force majeure cannot be proven”.

Article 936, as explained by the Court of Justice (TJ), describes that this is an ‘objective liability’, when there is no need to prove the guilt of the animal owner, it is enough that the animal causes damage and its owner responds.

Currently, the proposal awaits the appointment of a rapporteur at the Road and Transport Committee.
