The São Paulo Public Ministry charged the driver who caused a death at more than 100 km/h. The MP asked the Court for the preventive arrest of Fernando Sastre Filho.

The MP-SP accuses Fernando Sastre Filho of homicide with possible intent – when the risk of killing is assumed – and very serious bodily injury.

In the complaint, prosecutor Monique Ratton cited documents and statements that indicate that Fernando Sastre drank before driving. He denies it.

Fireman: Yeah, those guys were a little drunk, right?
PM: Yes yes.

According to the prosecutor, videos from the police’s body cameras indicate that Fernando and his mother, Daniela – who arrived minutes after the accident – tried to hide the boy’s drunkenness and leave without giving further clarification about the crash.

Mother: Everything has already happened to him, everything is with him now!
PM: But you can’t take him out of here like that. We have to qualify first and then you can withdraw.

The Public Prosecutor’s Office classified the police officers’ conduct as reprehensible. and asked the Court to share the evidence with the Military Justice Prosecutor’s Office, which must assess whether the police officers will face criminal proceedings.

Fernando Sastre’s defense declined to comment on the complaint.
