According to a statement from the European Commission, “fully qualified digital services coordinators in each Member State are essential for exercising the new rights created under the RSD, namely to ensure that users can lodge complaints in their place of residence against platforms , grant the status of trusted flaggers and enable investigators.

The European Commission today opened an infringement procedure against Portugal for not having been granted powers and competences to the coordinators of digital services.

Lisbon now has two months to inform the community executive of the due complementation of the aforementioned coordinators with “the necessary powers and competencies to carry out their functions, including the imposition of sanctions in case of non-compliance”, as provided for in the Digital Services Regulation (RDS ).
