Lawyers claim that Fernando did not flee the scene. They mention that, as help had already been provided to the other victims, the driver of the Porsche was “duly qualified by the military traffic police, and was released by the PM to be taken to the hospital”.

Defenders cite “the client’s need to protect themselves” after the accident. Garcia and Daychoum argued that the client protected himself due to fear of being lynched, pointing out the occurrence of a “virtual lynching” against Fernando, as well as the “shock caused by the accident and the news of the victim’s death.”

The defense also argued that Fernando presented himself spontaneously at the headquarters of the 30th Police District in São Paulo on Monday afternoon. “He was then able to give a statement, presenting his version of the facts.” Despite this, he reported himself to the police more than 38 hours after leaving the scene of the accident.

Fernando will collaborate with the investigation, says the note sent by the defense. “All the circumstances of the accident will be duly investigated during the investigation, with Fernando’s fullest collaboration.”

Defense says it will look for the victim’s family. Lawyers said their objective is to provide “solidarity” and offer necessary assistance. “Obviously, the loss will not be repaired, but we will at least provide the necessary support at this time of such a fatality”, they concluded.

Fernando Sastre de Andrade Filho, driver of the Porsche that collided with a Sandero and killed an app driver in the capital of São Paulo, was released from the police station on Monday night (1st) after giving a statement. He left the scene accompanied by his lawyers and drove away in a BMW.
