The Civil Police of Minas Gerais indicted businessman Rodrigo Rodrigues Andrade Chiatti for intentional homicideidentified as the responsible for overturning a Porsche 911 Carrera, valued at around R$800,000, in an accident that resulted in the death of passenger Cayke Pelegrino Tavaresin December 2023.

In a press conference this Wednesday, 24th, the delegate responsible for the investigations, Rodrigo Otávio Gomes Fagundes, explained that Andrade Chiatti will be charged with intentional homicide, drunk driving and lack of driving license. The person under investigation had his driving license revoked in 2012.

At the time of the accident, Andrade and Pelegrino were returning from a party at a nightclub in Belo Horizonte when the driver collided with a tree on Avenida Barão Homem de Melo, in the Estoril neighborhood. The expert found that the vehicle was traveling at 250 km/h in a life where the limit is 60 km/h.

“The person being investigated performed an absurd speed that I had never seen in other cases on a road of this nature. Given this combination of imprudence, the result of the action could hardly be different, unfortunately”, said the delegate.

The investigation revealed that the driver also consumed a significant amount of alcoholic beverages during the party, and even purchased another bottle before leaving the establishment. Images from surveillance cameras confirmed that Chiatti left the scene with the bottle in his hands.

Added to this was the fact that Chiatti was without a license at the time of the accident. According to the Civil Police, he had already been caught driving without a driver’s license three other times.

Request for preventive detention

After the conclusion of the investigation, the Civil Police indicted Chiatti, requested his preventive detention and requested the Court that he have his right to drive suspended, explained the delegate: “We understand that due to the recurrence of accidents in which he was involved in the past and the severity of the latter, that the investigation characterizes a danger to road safety”.

At the time, the driver was arrested in the act and had his arrest converted to preventive custody during a custody hearing. However, he was released after his defense presented a habeas corpus to serve alternative sentences.

Since December 29, he has been serving a precautionary measure using an electronic ankle bracelet, confirmed the Secretary of State for Justice and Public Security (Sejusp). Combined, the penalties for the crimes can reach 24 years in prison, according to the Civil Police.

Understand the case

The accident happened in the early hours of December 11, 2023, on Avenida Barão Homem de Melo, located in the Estoril neighborhood, in the western region of Belo Horizonte. According to the PM, the victims of the accident were returning from a party.

Witnesses reported that the vehicle, occupied by the two men, traveled several times along the stretch where the accident ended up happening. The passenger, Cayke Pelegrino Tavares, was thrown from the vehicle during the rollover and died at the scene of the accident.

During the investigation, it was found that the vehicle’s speedometer, valued at R$600,000, was stuck at 250 km per hour. The police confirmed that the driver’s license has been revoked since 2012. According to the police, the vehicle’s documentation is in good order.
