Released from prison after paying bail of one million euros (around R$5.45 million), Daniel Alves will be able to spend around a year in freedom awaiting appeals in the case that convicted him in the first instance of rape in Spain. There is no exact date to define the moment in which the sentence could be defined, but, as the case will have to go through the Superior Court of Justice and, eventually, the Federal Supreme Court, the most likely, according to the newspaper “Marca”, is that the final decision will only arrive at the beginning of 2025. For now, Daniel Alves’ sentence is four and a half years in detention, or 54 months. As he has already served 14 months of this sentence, and under Spanish law, pre-trial detention cannot exceed half of the sentence (i.e. 27 months), it is concluded that the final sentence will take around 13 months to be handed down.

The former Brazilian full-back was arrested on January 20, 2023 and, since then, he only left to attend the trial in February this year. Even though he was free, Alves had his Brazilian and Spanish passports withheld and must appear in court every Friday or, if that day is a holiday, on Thursday, as will happen this year at Easter. Until the sentence becomes final, and as long as there is no change in the court’s criteria, as the Public Prosecutor’s Office opposed his release from prison, the right-back will enjoy this provisional freedom. The days of provisional release do not count towards the possible sentence.

Daniel Alves’ sentence is not yet final, as an appeal is underway at the Superior Court of Justice of Catalonia. If either party is not satisfied with this decision, there will still be one more possible scenario to turn to: the Federal Supreme Court. In this case, neither party – the Brazilian or the Public Ministry – would have more instances to appeal to, and the decision would be assumed to be definitive.
