Two witnesses, a woman and a man, who were traveling along Avenida Salim Farah Maluf, in the east zone of São Paulo, at the time of the collision, told what they saw on Tuesday (2) to the police officers of the 30th Police District (DP) , from Tatuapé.
The woman reported that she saw the Porsche overtaking in high speed and even commented to the other people who were in the car with her that an accident would happen. “He’s going to hit,” she said.
The man said he also saw the overtaking at high speed. Afterwards, he heard a loud banging noise and saw the two vehicles, the Porsche and Ornaldo’s Renault Sandero, stopped on the road.
The woman also told the police that Fernando “appeared to be drunk, was staggering, had a slurred voice and couldn’t say what was happening. He just asked to get out of his way.”
She also stated that none of the Porsche occupants or family members who arrived after the collision “provided any type of attention or assistance to the victim in the Renault Sandero.”

Escape from the scene of the accident
The two also said that Fernando’s mother and girlfriend wanted to remove him and his friend from the scene before rescuers and the Military Police arrived. The woman said she got into an argument with one of them, saying that they would only leave “after the other driver is attended to by the rescue team.”
The man said he was trying to help Ornaldo, who was unconscious in the driver’s seat of the Sandero, when he twice heard people at the scene say that Fernando wanted to escape.
The accident
App driver Ornaldo da Silva Viana, 52, was driving a white Renault Sandero along Avenida Salim Farah Maluf, around 2:30 am on Sunday (31), when he was hit in the rear by a Porsche 911 Carrera, driven by Fernando Sastre de Andrade Filho, 24 years old.
Ornaldo was rescued by the Fire Department and taken to Tatuapé Municipal Hospital, where he was admitted with a cardiorespiratory arrest. According to the doctors who treated him, he died “due to unspecified multiple traumas.”
Fernando’s mother arrived at the scene of the accident, telling the police that she would take her son to Hospital São Luiz Ibirapuera, in the south of São Paulo, because of a minor injury in the mouth area. When the police went to the hospital to perform a breathalyzer test and hear his version of what had happened, they were informed by employees that he was not admitted to any of the São Luiz Network hospitals.
Fernando went to the police station, accompanied by lawyers, on Monday, almost 40 hours after the accident. He was heard and indicted for intentional homicidebut was released.
The Porsche owner denied that he had been drinking or using drugs. He said he was at a poker house but didn’t take a sip of alcohol. The police will ask for his bank secrecy to be broken so they can know all his expenses that night.
The Civil Police asked the temporary arrest of Fernando, but the Court denied.
