Ongoing legal actions charge a 40% hazard pay premium for Otoclinica workers who worked during the Covid-19 period: find out how to proceed

In 2020, Sindsaúde Ceará’s legal consultancy joined the Labor Court with a collective action seeking additional unhealthy conditions, at the maximum level, that is, 40% of the minimum wage, for OTOCLÍNICA employees who were exposed to risks biological originating from coronavirus/Covid-19.

The court’s expertise indicated that 1,177 employees, represented by Sindsaúde, should be receiving an additional 40%. However, the company, even though it was aware of the lethal risk to which employees were subjected during the pandemic period, did not respect the conclusions of the expert report and continued paying only 20% of the hazard pay premium, which, in fact, should have been 40%. %.

After three years of progress in the process, the judge determined that the execution must be carried out individually for each of the employees involved. This means that now more than a thousand actions are underway.

However, to initiate these processes, the Court requires each employee to present a power of attorney and personal documents.

IMPORTANT: It is worth mentioning that those affiliated with Sindsaúde Ceará do not pay anything for this process, however, non-affiliated workers must pay 20% of lawyers’ fees. However, if the worker joins now, there will be a 10% reduction in the amount to be paid in this percentage of fees.
